RESOLUTION OF SMALL BUSINESS AND CONTRACT DISPUTES
Our principals have managed their own business, and division of large corporations, and have consulted to small businesses in business disputes. They have dealt with vendors of all kinds and have negotiated contracts of all types and sizes.
It is our belief, based on many years of experience, that parties enter into business arrangements and contracts in good faith, with the intent of such arrangement being a win win outcome for all parties.
When a dispute does occur, it is often a result of a misunderstanding, poor communication, or a change in the initial framework. Strong opinions are developed, egos take over, and a lawsuit soon arises.
The alternative to the lawsuit is mediation. Our experienced mediators will:
- Meet with both parties to gain knowledge on the factors leading to the dispute.
- Review all written material (contracts, letters, etc) related to the dispute.
- Meet individually with each party to determine the position of each, with particular emphasis on what each party hopes to receive with a “successful outcome”.
- Continue to mediate discussions until an agreement is reached or it becomes clear that agreement is not possible.
