DIVORCE MEDIATION
WHAT IS DIVORCE MEDIATION?
Divorce Mediation is the process which a married couple, having decided to obtain a divorce, goes through to resolve all the issues necessary to obtain a legal divorce. The mediation process is administered by an experienced mediator who identifies the issues that need resolution, obtains the views of each party on these issues, recommends compromises for each party to consider, attempts to reconcile any differences, and moves the parties to agreement.
The mediator documents the agreement in a form which, in many states, can be filed directly with a family court, or can be provided to attorneys for final review and presentation to the court.
WHAT ARE THE BENEFITS OF DIVORCE MEDIATION?
The major benefit of divorce mediation is a reduction in the potential legal costs often incurred in a contentious, time-consuming divorce proceeding. When the two parties seeking a divorce are open to mediation and approach the process in a respectful and constructive manner, the mediator can most often complete the process within a two week period.
The shorter time frame also has the benefit of reducing the stress on each party that often accompanies a divorce proceeding.
WHAT ISSUES ARE ADDRESSED IN MEDIATION?
Most often, the mediator will work with the couple to address the following issues:
- division of personal property
- automobiles
- retirement accounts
- bank accounts/stocks/other assets
- credit cards
- division of real property
- alimony
- parental responsibility for any children, including provision for any special needs.
- Visitation schedule for children
- Child support
- Health insurance
- College education for children
- Tax considerations
All issues are discussed in detail with the mediator leading the discussion, in an attempt to reach a final resolution on each issue.
