MEDIATION OF EMPLOYMENT DISPUTES
Today’s workplace has become an increasingly complex area in which to survive, let alone succeed.
Most employees, at least once in their working careers, find themselves in a potential conflict with their employer. On the other hand, employers are continually faced with employee concerns, complaints and potential legal actions.
As a means of avoiding the legal process, mediation should be attempted to resolve the conflict to the satisfaction of both parties (employee and employer).
The experienced mediator will:
- Meet with the parties to gain an understanding of the dispute, its root causes, and the positions of each party.
- Review all relevant background materials, such as employment contracts and letters, union agreements, annual reviews, warning letters, etc.
- Meet with each party individually to determine what each seeks and the compromises each party is willing to make.
- Formulate a position which the mediator believes might represent a reasonable compromise point for each party.
- Meet jointly with the parties and attempt to resolve the issues.
